Terms of Use of the TUFI profi website

1. Introduction

1.1. These Terms and Conditions define the conditions for using the tufiprofi.pl website (hereinafter – the «Website»).

1.2. By using the Website, the user accepts the terms of these Rules. In case of disagreement with any of the provisions, the user is obliged to stop using the Website.

1.3. Online payment processing on the Website is carried out by Autopay S.A. and other payment operators.

3. Registration and User Account

3.1. To make purchases or use certain functions of the Website, the user must register an account.

3.2. The user is obliged to provide accurate and complete data during registration.

3.3. The user is responsible for the security of their password and all actions performed from their account.

3.4. The Website Administrator has the right to block or delete a user's account in case of violation of the provisions of these Rules.

4. Purchases on the Website

4.1. The user can order goods presented on the Website in accordance with the terms specified for each product.

4.2. Order confirmation constitutes the conclusion of a purchase and sale agreement between the user and TUFI profi.

4.3. Placing an order on the Website is possible only after accepting these Rules and the Privacy Policy.

4.4. During promotional campaigns, gifts for orders may be added to receipts and invoices marked “gift” at a price of 0.01 PLN.

5. Prices and Payment

5.1. Product prices on the Website include Value Added Tax (VAT).

5.2. The user is obliged to pay for the order using one of the available payment methods:
Bank cards: Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro.

5.3. In the absence of payment within the established period, the order may be canceled.

6. Returns and Complaints

6.1. A consumer who has entered into a distance selling contract or an off-premises contract has the right to withdraw from it without giving a reason within 14 days.

6.2. More detailed information on returns and complaints is available in the «Returns and Complaints» section.

6.3. If it is necessary to refund funds for a transaction made by the user using a bank card, the refund is made to the bank account associated with the customer's card.

7. Order Processing Times

7.1. Order processing time is calculated from the moment of successful payment confirmation.

7.2. In case the user chooses to pay by bank transfer or card – from the moment the funds are credited to the seller's bank account.

8. Delivery

8.1. Delivery is carried out to the address specified by the user in the order form.

8.2. Delivery time depends on the chosen delivery method and the availability of goods.

9. Liability

9.1. TUFI profi is not responsible for malfunctions in the Website's operation caused by technical problems beyond the Website's control.

9.2. The user is responsible for the accuracy of the data provided during registration and ordering.

10. Protection of Personal Data

10.1. The administrator of the personal data of the Website users is:

10.2. Users' personal data are processed in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

10.3. Personal data are processed for the following purposes:

• Execution of the purchase and sale agreement and order processing (Art. 6 (1)(b) GDPR);
• Processing of complaints and returns (Art. 6 (1)(c) GDPR);
• Maintaining a user account on the Website (Art. 6 (1)(b) GDPR);
• Fulfillment of legal obligations (Art. 6 (1)(c) GDPR);
• Marketing and advertising purposes based on consent (Art. 6 (1)(a) GDPR);
• Protection and assertion of possible claims (Art. 6 (1)(f) GDPR).

10.4. The recipients of personal data may be:

• Companies processing online payments (e.g., Autopay S.A.);
• Courier services and logistics service providers;
• Companies providing accounting, legal, and IT services to the Administrator.

10.5. Personal data will be stored for:

• The period of execution of the contract and the time required by law (at least 5 years);
• Until the withdrawal of consent for marketing purposes;
• Until the expiration of the statute of limitations for possible claims.

10.6. The user has the right to access, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent.
